Like the majority of Trump’s Cabinet members, U.S. Attorney General Pam Bondi was nominated more for her loyalty to him than for her actual qualifications for the post.
Although the position of Attorney General was created by the Judiciary Act of 1789 and signed into law by President George Washington, the Attorney General became the head of the Justice Department after it was established in 1870. The Justice Department came into existence due to the high volume of litigation following the Civil War and the passage of the 13th, 14th, and 15th Amendments. One of the first directives for the new Justice Department was to enforce the civil rights of the newly freed Black Americans and protect them from the violence of the Ku Klux Klan. The office of the Solicitor General was also established in 1870, and its primary function is to represent the United States before the Supreme Court.
As head of the Justice Department, the Attorney General's (AG) primary job is to enforce federal laws and the rulings of the Supreme Court, and to defend and enforce the Constitution, as outlined in the oath taken upon assuming the job. The AG also serves as the president's primary legal advisor.
This is where the suggestion comes to impeach Attorney General Pam Bondi for repeatedly breaking her oath of office.
Bondi was formerly the AG of Florida, and after her tenure in that office, she became a staunch supporter of Donald Trump, including being appointed as a special adviser during his impeachment proceedings.
However, as Attorney General, Bondi works for the U.S. government and for the people. She does not work for Trump, and she is not supposed to advise him to ignore SCOTUS rulings. Nor should she claim that a legal resident married to an American citizen with no criminal record or gang ties, who was “accidentally” sent to a prison in El Salvador, does not have to be immediately returned to the U.S. That statement is specifically against a recent SCOTUS ruling. Her job is to ensure that SCOTUS rulings are followed, not ignored.
Bondi has also stated that “due process” does not have to apply to any immigrant, documented or not. The 5th Amendment states that “ALL persons” have a right to due process, with NO exceptions.
Although several attorneys general (AGs) throughout American history have had Articles of Impeachment filed against them, including Eric Holder and Merrick Garland, none were approved by the House Judiciary Committee. Therefore, the AGs were not impeached.
During the Bush 43 administration, Articles of Impeachment were filed against Attorney General Alberto Gonzales, and the pressure on him was so great that he resigned.
We can be fairly certain that Speaker of the House Mike Johnson would not allow any attempts to impeach Bondi even to reach the Judiciary Committee for a vote. We should still try, and certainly continue to highlight her unconstitutional actions and disparate beliefs that contradict the oath she took.
What do you think about the actions of the current Attorney General of the United States?
